Information on the Processing of Personal Data

I. Basic Provisions

  1. The data controller pursuant to Art. 4 para. 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: "GDPR") is AD4NET s.r.o. Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, network identifier, or to one or more specific characteristics of the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
  4. The controller has not appointed a data protection officer.

II. Sources and Categories of Processed Personal Data

  1. The controller processes personal data you have provided or personal data obtained by the controller in connection with fulfilling your order.
  2. The controller processes your identification and contact data as well as data necessary for the performance of the contract.

III. Legal Basis and Purpose of Processing Personal Data

  1. The legal basis for processing personal data is
    • the performance of a contract between you and the controller pursuant to Art. 6 para. 1 letter b) GDPR,
    • the legitimate interest of the controller in providing direct marketing (especially for sending commercial communications and newsletters) pursuant to Art. 6 para. 1 letter f) GDPR,
    • your consent to processing for the purposes of direct marketing (especially for sending commercial communications and newsletters) pursuant to Art. 6 para. 1 letter a) GDPR in conjunction with § 7 para. 2 of Act No. 480/2004 Coll. on certain services of the information society, in cases where no order for goods or services has been placed.
  2. The purpose of processing personal data is
    • to process your order and exercise the rights and obligations arising from the contractual relationship between you and the controller; when placing an order, the personal data required for successful processing (name and address, contact details) are collected; the provision of personal data is a necessary prerequisite for the conclusion and performance of the contract; without the provision of personal data, it is not possible to conclude or fulfil the contract on the part of the controller,
    • to send commercial communications and perform other marketing activities.
  3. The controller does not make automated individual decisions within the meaning of Art. 22 GDPR.

IV. Duration of Data Storage

  1. The controller stores personal data
    • for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to assert claims from these contractual relationships (for a period of 15 years after the end of the contractual relationship).
    • for the period until consent to the processing of personal data for marketing purposes is withdrawn, but no longer than 15 years if the personal data are processed on the basis of consent.
  2. After the expiration of the retention period, the controller will delete the personal data.

V. Recipients of Personal Data (Controller's Subcontractors)

  1. Recipients of personal data are persons who
    • are involved in the delivery of goods/services/payment execution based on a contract,
    • are involved in ensuring the operation of services,
    • provide marketing services.
    The controller does not intend to transfer personal data to a third country (outside the EU) or to an international organization.

Personal data may also be processed by the following processors:
• Web hosting provider CZECHIA.CZ
• If applicable, other providers or suppliers of web systems, services, and applications currently used by the company (e.g., TENHIL, stellenanzeigen.de, etc.).

VI. Your Rights

  1. Under the conditions set out in the GDPR, you have
    • the right of access to your personal data under Art. 15 GDPR,
    • the right to rectification of personal data under Art. 16 GDPR or to restriction of processing under Art. 18 GDPR.
    • the right to erasure of personal data under Art. 17 GDPR.
    • the right to object to processing under Art. 21 GDPR, and
    • the right to data portability under Art. 20 GDPR.
    • the right to withdraw consent to processing in writing or electronically to the address or e-mail address of the controller specified in Article I of these terms.
  2. You also have the right to lodge a complaint with the data protection authority if you believe that your right to the protection of personal data has been violated.

VII. Conditions for the Security of Personal Data

  1. The controller declares that he has taken all appropriate technical and organizational measures to protect personal data.
  2. The controller has taken technical measures to secure data storage and storage of personal data in paper form, in particular by using antivirus programs, creating backups, securing with strong passwords, and storing in secure rooms.
  3. The controller declares that only persons authorized by him have access to personal data.

VIII. Final Provisions

  1. By submitting an order via the online order form, an inquiry, or an application, you confirm that you have read and fully accept the privacy policy.
  2. The controller is entitled to amend these conditions. The new version of the privacy policy will be published on his website or sent to the e-mail address you provided to the controller.

These conditions enter into force on 01/07/2025.
